Cigar Industry Report: Volume 6, Number 36 (Edition 237 7/29/17)

Feature of the Week: Rough Week for Cigar Industry Ends on Positive Note 

First it was news of Marco Rubio’s fight to get a premium cigar exemption on the Senate Appropriations Bill; then it was the ruling against the vape industry that cast doubt on whether the courts can change the predicate date, and finally it was several anti-tobacco groups petitioning the Court to be named as defendants in the cigar industry’s lawsuit against the FDA. All sad news, but things changed yesterday.

FDA Commissioner Scott Gottlieb announced a near-three-year delay for cigar makers to be required to get agency approval for any product marketed after February 15, 2007. This moves the deadline from November 8, 2018 to August 8, 2021 to keep a non-grandfathered product on the market.

Legislative News

  • House of Representatives: H.R. 564 is a proposed piece of legislation that calls for an exemption from FDA Regulation for premium handmade cigars. This week no new co-sponsors were added. The total number of sponsors is now 121.
  • U.S. SenateS.294 is the Senate companion bill to H.R. 564. This week Rob Goodall [R-Georgia] signed on as a co-sponsor. The total number of sponsors remains at 16.
  • House Bill 1136: H.R. 1136 is the legislation to change the Grandfather Date for Deeming Tobacco products subject to FDA Regulation from February 15, 2017, to 21 days after enactment of the regulations. This week four new co-sponsors were added: Tom Marino [R-Pennsylvania], Scott Desmarais [R-Tennessee], Elise Stefanik [R-New York], and Doug Collins [R-Georgia]. The total number of sponsors is now 83.
  • Maine: Governor Paul LePage vetoed a bill that would have raised the age to purchase tobacco in the state to 21.
