Feature of the Week: Comment Period Concludes Around FDA’s Draft Guidance for Substantial Equivalence

The period opened by the U.S. Food and Drug Administration to solicit comments around the Draft Guidance has concluded. Comments have been submitted by various groups including: Cigar Rights of America, Cigar Association of America, the Premium Cigar Association, and a group of six large manufacturers. We will have more details and analysis this week on Cigar Coop.

Legislative News

  • U.S. Senate: S.9 is a proposed piece of legislation that calls for an exemption from FDA Regulation for premium handmade cigars. This week Senator Rick Scott [R-Florida] was added as a co-sponsor. The total number of sponsors is now at 15.
  • U.S. House of Representatives: H.R.1854 is the House Companion Bill to S.9. This week Glenn Thompson [R-Pennsylvania], Rob Estes [R-Kansas] and Kelly Armstrong [R-North Dakota] were added as co-sponsors. The total number of sponsors is now at 76.
  • FDA:  Maryland Judge Paul Grimm has set the deadline for Substantial Equivalence applications to be May 12, 2020. This is the result of a recent court ruling that a group of health organizations filed challenging the timetable the FDA put in place for Substantial Equivalence – throwing out the August 8, 2021, date set by former FDA Commissioner Scott Gottlieb. The cigar industry has filed a motion to appeal this ruling.
  • New York: The State has raised the tobacco purchase age to 21.
  • Ohio: Governor Mike DeWine has signed a budget bill that raises the tobacco purchase age to 21.
