Robert F. Kennedy Jr. has been confirmed as the Trump Administration’s new Secretary for the Department of Health and Human Services (HHS). He was confirmed by the United States Senate by a vote of 52-48.
The HHS is the executive branch that oversees the U.S. Food and Drug Administration (FDA). The FDA has the authority to regulate cigars; however, the Deeming Rule that defines this regulation has been vacated by the courts, and the FDA’s appeal has been unsuccessful.
It is unclear what Kennedy’s position is on tobacco. Kennedy is the son of U.S. Attorney General and Senator Robert F. Kennedy and the nephew of U.S. President John F. Kennedy and Senator Ted Kennedy. He ran unsuccessfully for President in 2024.
Meanwhile, President Trump has nominated Dr. Marty Makary as the new FDA Commissioner. Makary’s appointment is still to be confirmed. Dr. Sara Brenner will serve as acting commissioner until a commissioner is confirmed. Dr. Brenner is filling the role following the resignation of President Biden’s FDA Commissioner, Dr. Robert Califf.
